What Should You Do If Your Disability Claim has been denied?

By: Steven Ross

What is the proper course of action to take if your disability claim has been denied? I will show you in this article, in a step-by-step process, the action you can take to make sure you appeal properly. Just take this advice and put it to use for you and your situation, to assure you follow up correctly if your disability claim has been denied.

Denial on your disability claim is something you should not take personally. This is because the Social Security administration office denies over 60% of initial claims. While some claims are just plain fraudulent, most often claims are denied because they lacked the proper information required on the application.

You can file for a request for reconsideration, if you feel you have more information, or can present your disability better than when you first filed. Use this as a chance to strengthen your claim by securing additional documents and medical records. You should consider anything that you think will help strengthen your case when you file for your request for reconsideration.

Your request for reconsideration can take anywhere from two weeks to six months of processing before it is approved. This is because it depends on how many cases are currently pending in the Social Security administration's office, as well as what new information you have provided to them.

There are different grounds of denial, regarding your initial claim. So when you file the request for reconsideration, you need to file the proper appeal form, which can be located by contacting your local Social Security Administration office. As long as you file your appeal within 60 days or your denial, your request for reconsideration will be reviewed.

If you're request for reconsideration is also denied, it's time to go to the next level of appeal. This is where you will stand before an administrative law judge, and orally argue your case. If you find yourself in this situation, it may be wise to consult a disability lawyer.

There's still hope for you, even if you're denied by an administrative law judge. If you're claim is a legitimate one, consider appealing directly to the Social Security Administration Appeals Council. If they deny you, your last resort is to take your claim to Federal District Court.

In closing, you now know what to do if your disability claim has been denied. Simply make the proper appeal, based on this information, and take action on getting your disability claim approved.
